На основі доповідей виголошених на конференції, організованій
Товариством дослідників права Східних Церков у Венеції 2009 р.
під назвою «Форми автономії у Східних Церквах», стаття пояснює
різні форми автономії, які існують в Церкві – православній і
католицькій. При цьому показано, що автокефалія і автономія не
є синонімами. Можуть також існувати різні форми «автономії».
Наголошується, що завдання канонічного права є відповідати
еклезіологічному розумінню Церкви, що є синодальним і помісним.
Це часом вимагає змінити спосіб думання, що його назива-
ють «декомпресією загального права». Історія багата на «bottonup
»-автономії, коли помісна Церква отримує автономію від все-
церковних структур, як також «top-down»-автономії, коли Церква
усвідомлює потребу в автономії, до неї доростає, а всецерковна
спільнота це визнає. Також подаються історичні приклади того,
що різні автономні Церкви такими стали тільки після періоду
«схизми», що ніяк не вплинуло на їхню спасительну місію серед
свого народу. |

dc.description.abstracten |
The article consists of the reports delivered at the conference «Forms
of Autonomy in the Eastern Churches» organized by the Researchers
of the Society for the Law of the Eastern Churches in Venice, 2009. It
explains various forms of autonomy that exist both in the Orthodox
and Catholic Church. It also shows that autocephaly and autonomy
are not synonymous. It is suggested that most likely there exist various
forms of «autonomy.» It is emphasized that the task of the Canon Law
is to correspond to the ecclesiological conception of the Church, which
is synodal and local. This sometimes requires a change in the way of
thinking, called «decompression of the common law.» History is rich in
«botton-up»-autonomies, when the local Church receives its autonomy
from the whole Church structures, as well as the «top-down»-autonomies,
when the pomisna Church recognizes the need for autonomy,
it grows up to it, and the whole Church community recognizes it. In
addition, the article presents historical examples, showing that various
Churches became autonomous only after a period of «schism,» which
had not had any impact on their saving mission among the people. |
